These numbers include Family Based and as per my understanding 90 % of the applications are FB based.
For us who are EB based, the EB backlog should be more realistic and I am not sure how do we get them!

I listened intently to President Obama's State of the Union speech yesterday. The man is clearly a gifted orator. He stressed the need for cooperation between Democrats and Republicans on the big issues facing our country: the economy, climate change and health care reform, but where oh where was immigration? We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

Hi,
I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.

My attorney sent in EAD renewal applications for me and my spouse. We got a receipt from USCIS yesterday with a MSC receipt number with some information on scheduling biometrics. I called my attorney and asked him about the same. He said that this is normal as he did the right thing by sending our application to a lock box address in Chicago. We are wisconsin residents. Please advise if this is fine to get a recipet notice from the Missouri service center address.

Hi All,
I have a question regarding my wife's H1B Status.
My wife got H1B stamped in hyderabad consulate last year. Due to recession, she applied for H4 to join me in US, got H4 stamping in hyderabad, during which
H1 Visa was cancelled[expected..]. we have H1B Petition docs which says it is valid for 3 years. My wife came to US on H4.
Now can't she apply for Change of status from H4 to H1 as we have petition docs, which are valid for 3 years?
when contacted the actual employer, they said, when H1 visa is cancelled, it means, H1B petition also cancelled. Is it true?
Please suggest.

My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.
Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

Hi all,
I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

2. Trying to renewe EAD/AP (Didn't use both until now).
3. Instructions of I-131 has the following statement
If you travel before the advance parole document is issued, your application will be deemed abandoned if:
A. You depart from the United States; or
B. The person seeking advance parole attempts to enter the United States before a decision is made on the application.
My question:
1. Does my applying for renewal of EAD and AP affect my travel?

Until we ask they don't give anything, I have been writing to Ombudsman, for this and have raised it on an Ombudsman call, but USCIS is just too much...

I have applied for my PERM Labor Certification on Aug, 6th'07. My status online shows "IN PROCESS". DOL called my employer's contact to verify submission on Aug, 15th'07.
My Lawyer states that rather than preparing for I-140 / I-485. I would be best served in working on preparing a response to the audit that will be coming, because of the Spanish language requirement.
Is he just getting ready for a "just-in-case" audit...? Should I prepare the I-140 and deal with the audit on the 30-days if DOL sends the Audit letter? How long would it take to receive this letter?
